These terms govern your use of Marginalia, a social reading application operated by Digitalheads (digitalheads.pl). By creating an account, you agree to these terms and our Privacy Policy.
What Marginalia is
Marginalia is a social reading app for DRM-free EPUB files. You upload your own legally obtained books, read them in the browser or on your device, highlight passages, write notes, and optionally share your annotations with other users.
Your account
- •You must be at least 16 years old to create an account
- •You may only create one account per person
- •You are responsible for keeping your login credentials secure
- •You can delete your account and all associated data at any time from the Settings page
Your content
- EPUB files
- You must have the legal right to the books you upload. Marginalia does not verify copyright ownership and is not responsible for the legality of uploaded files. You retain full ownership of your files.
- Highlights and annotations
- You own your highlights and notes. By setting a highlight to "public," you grant Marginalia a limited license to display it to other users within the app (in feeds, profiles, and in-book social highlights). You can revoke this at any time by setting highlights back to private or deleting them.
- Profile information
- You control what is visible on your public profile. You can make your reading activity private at any time through your privacy settings.
Acceptable use
You agree not to:
- •Upload content you do not have the legal right to use
- •Harass other users through annotations, highlights, or social features
- •Use automated tools to scrape or bulk-access other users' data
- •Impersonate other people or organizations
- •Attempt to interfere with the security or availability of the service
Copyright and takedown requests
Marginalia respects copyright. If you believe that content on our platform infringes your rights, please send a takedown notice to legal@digitalheads.pl including:
- •Identification of the copyrighted work
- •Identification of the infringing material and its location on Marginalia
- •Your contact information and a statement that you are authorized to act on behalf of the rights holder
We will review valid requests promptly. Accounts with repeated valid copyright complaints may be terminated.
Marginalia Pro
Marginalia offers a paid subscription tier ("Marginalia Pro") with additional features.
- •Pricing — $35/year
- •Billing — Through the Apple App Store, Google Play Store, or direct payment
- •Cancellation — You can cancel at any time. Your Pro access continues until the end of the current billing period
- •Refunds — In-app purchases are subject to the refund policies of the respective app store. For direct payments, contact us within 14 days for a full refund
Service availability
Marginalia is provided "as is" without guarantees of uptime or availability. We make our best effort to keep the service running reliably, but we do not offer a service-level agreement.
We may modify, suspend, or discontinue part or all of the service at any time. When possible, we will provide reasonable advance notice of significant changes.
Limitation of liability
To the fullest extent permitted by applicable law, Marginalia and Digitalheads are not liable for:
- •Loss of data, including uploaded EPUB files, highlights, or annotations
- •EPUB rendering issues or display inconsistencies
- •Content of user-generated highlights, annotations, or profile information
- •Service interruptions or downtime
- •Any indirect, incidental, or consequential damages arising from the use of Marginalia
Termination
- •You can delete your account at any time. All your data will be permanently removed as described in our Privacy Policy
- •We may suspend or terminate accounts that violate these terms, with notice where practicable
Governing law
These terms are governed by the laws of Poland. Any disputes will be subject to the jurisdiction of the courts in Poland. If you are a consumer in the EU, this does not affect your rights under mandatory consumer protection laws of your country of residence.
Changes to these terms
We may update these terms from time to time. When we make significant changes, we will notify you through the app or by email. Continued use of Marginalia after the notice period constitutes acceptance of the updated terms.
